ARTTIC DESIGN reserves the right to modify or amend the Site Terms at any time, at its sole discretion. If the Site Terms are changed, ARTTIC DESIGN will post the updated terms on this Website and revise the “last updated” date above. Changes become effective upon posting. By continuing to use this Website, you acknowledge and accept any such modifications.

If you do not agree with any change or amendment, you may withdraw your consent by notifying ARTTIC DESIGN in writing immediately. Upon withdrawal, you must discontinue use of this Website. Your account will be deactivated, though you remain responsible for payment of any jobs already completed or in production.

ELECTRONIC COMMUNICATION

By using this Website, you consent to receive communications from ARTTIC DESIGN electronically. These communications include emails sent to the address you provide and notices posted on the Website. You may withdraw consent to receive electronic communications prospectively by contacting us, but doing so will disable your ability to use this Website or order further products or services.

SITE USE

You are granted a limited license to use this Website solely to review product and service offerings and to place orders for products and services offered by ARTTIC DESIGN. You may not copy, reproduce, distribute, publish, modify, or create derivative works from any part of this Website or its content without express written consent.

You agree not to use ARTTIC DESIGN products or services for illegal, unauthorized, or improper purposes including unsolicited advertising, spam, or pyramid schemes. ARTTIC DESIGN may terminate your access for any misuse of this Website or violation of applicable law.

REGISTRATION

To place orders, you may need to create an account with ARTTIC DESIGN. You agree to provide accurate, current information and to keep your password secure. You are responsible for all activity under your account. Notify ARTTIC DESIGN immediately if you believe your credentials have been compromised.

CUSTOMER PROVIDED CONTENT

For certain products and services, you may upload or submit data, text, photographs, graphics, or other materials (“Customer Content”). You represent that you own or have rights to all Customer Content submitted. You agree to defend, indemnify, and hold harmless ARTTIC DESIGN and its affiliates against any claims arising from your content or its use.

ARTTIC DESIGN reserves the right to remove or refuse any Customer Content it deems inappropriate, unlawful, or in violation of these Terms. Customer Content linked to orders may be stored up to thirty (30) days, after which it may be deleted and unrecoverable.

USE OF DESIGN TOOLS

If you create designs using ARTTIC DESIGN online tools or templates, you do not obtain ownership of any underlying design elements. Such elements remain the property of ARTTIC DESIGN or its licensors. You are solely responsible for ensuring that your designs do not infringe third-party rights.

UPLOADED CONTENT REQUIREMENTS

We recommend files be uploaded at a minimum resolution of 300 DPI at 100% size and designed in CMYK color format. Files not meeting these standards may experience print issues such as pixelation or color shift, for which ARTTIC DESIGN assumes no responsibility.

COLOR QUALITY

My Powerful Ideas guarantees printing within standard CMYK industry tolerances but cannot guarantee exact color matching. Differences may occur due to monitor display or RGB-to-CMYK conversion. We are not liable for slight color variations, including those affected by finishing processes such as lamination or coating.

PRODUCTION TURNAROUND TIME

Although we strive to ship exact quantities, ARTTIC DESIGN reserves the right to deliver within ±5% of the ordered quantity. Orders are printed “as submitted,” and customers are responsible for verifying spelling, layout, and design before approval. Once approved for production, changes cannot be made.

PROMOTIONS & DISCOUNTS

Coupon codes, promotions, and discounts are subject to their stated terms and validity periods. Promotions may not be combined or redeemed for cash and may be discontinued at any time. If an order using a coupon is cancelled or returned, refunds will apply only to the amount actually paid.

PAYMENT

All prices are listed in U.S. dollars. ARTTIC DESIGN accepts major credit and debit cards and other payment methods available through our Shopify checkout (including Shop Pay, PayPal, Apple Pay, or Google Pay). Orders must be paid in full at the time of purchase. Unauthorized or failed payments may result in order cancellation.

ORDER CANCELLATION

Orders cannot be cancelled once files are uploaded and production has started. If cancelled prior to production, cancellation fees may apply. Custom design or setup fees are non-refundable.

INTELLECTUAL PROPERTY

This Website, its layout, design, and all related content are the property of ARTTIC DESIGN and protected by copyright and trademark law. “ARTTIC DESIGN” and associated logos are trademarks of ARTTIC DESIGN. and may not be used without written consent. All other trademarks remain the property of their respective owners.

DISCLAIMER OF WARRANTY / LIMITATION OF LIABILITY

THIS WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS.” ARTTIC DESIGN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ARTTIC DESIGN IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM USE OF THIS SITE OR OUR PRODUCTS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE ORDER IN QUESTION.

GOVERNING LAW

These Terms and your use of this Website shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes shall be brought exclusively in the state or federal courts located in Miami, Florida, and you consent to their jurisdiction.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Arttic Design, its officers, employees, agents, affiliates, and suppliers from any claims, damages, or expenses (including attorneys’ fees) arising out of your breach of these Terms or your use of this Website and services.

SECURITY AND PRIVACY

TERMINATION

Arttic Design may suspend or terminate your account or access to this Website at its discretion if you violate these Terms. Upon termination, these Terms remain applicable to prior transactions and obligations.
